The flavored vape ban in Rhode Island, which went into full effect on January 1, 2025, continues to cast a long shadow over our industry more than a year later. What began as a well-intended effort to curb youth access to vaping has instead delivered a devastating blow to legitimate small businesses across the state, including ours.

Over the past 13+ months, our revenue at White Horse Vapor has remained down by roughly 80% from pre-ban levels. The shelves that once showcased an array of appealing flavors—strawberry, vanilla custard, cool mint, and countless others—now hold only tobacco and menthol options. Customers who relied on these varieties to make the switch from traditional cigarettes walk in, look around, express disappointment, and often leave without purchasing. Many have told us directly that they’ve resorted to buying from neighboring states, online gray markets, or heartbreakingly, returned to combustible tobacco products that carry far greater health risks.

This isn’t an isolated hardship. Specialized vape shops throughout Rhode Island have faced similar or worse fates. Numerous independent retailers have closed permanently, laying off employees, forfeiting leases, and closing chapters on years of community involvement. On October 21st, White Horse Vapor hosted a sponsored advocacy event inside the Rhode Island State House to respectfully address the growing fallout from the state’s flavored vapor ban, which went into effect January 1st, 2025. With three White Horse Vapor representatives in attendance, joined by our dedicated State Advocate, the event aimed to deliver a clear message: the flavor ban is hurting Rhode Islanders, not helping them.

Throughout the evening, various Rhode Island House Representatives stopped in for direct, open discussions about the unintended—and very real—consequences the ban has had on public health, small businesses, and state revenue. While public policy should protect citizens, especially youth, the current ban is instead driving adults back toward combustible cigarettes—the very products responsible for the overwhelming majority of tobacco-related disease and death.

The Most Concerning Trend: More Adults Returning to Cigarettes

One of the points that resonated most strongly with House members was the unmistakable shift in consumer behavior since the ban took effect.

With flavored vapor products removed from the legal market, many former smokers have reverted back to traditional cigarettes—products that remain fully available, fully flavored, and totally deadly.

Why is the FDA attempting a Geek Bar ban and Other Vapes Being Blocked at the U.S. Border?

In recent months, U.S. Customs and Border Protection (CBP), in coordination with the FDA, has dramatically escalated enforcement efforts against “unauthorized” vape imports, especially targeting popular brands like Geek Bar Pulse. This crackdown has led to millions of dollars’ worth of disposable vapes, especially those imported from China, being seized at U.S. ports. The FDA states that a staggering $136 million in illegal e-cigarettes have been confiscated since 2023, including a May 2025 seizure in Chicago involving nearly 2 million units valued at more than $33 million. FDA officials vowed earlier this year to “stop unauthorized e-cigarettes at the border”, a promise that is now coming to fruition.

Geek Bar is a widely-used disposable brand whose popularity has made it a primary target for enforcement. Shipments of Geek Bar have plummeted from approximately 1,200 per month last year to only 71 in May 2025. These seizures are driven by both FDA seizures and steep tariffs ranging from 30% to 145% on Chinese-made vapes.
